These Terms of Use (“Terms”) govern your access to and use of CreditSoup.com (the “Site”), operated by BMG Services LLC, a Delaware limited liability company, doing business as CreditSoup (“CreditSoup,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to be bound by these Terms.

1. Description of Services

CreditSoup provides a free online service that helps consumers evaluate and discover credit card and loan offers based on their financial profile.

  • Is not a lender, bank, loan broker, credit repair organization, credit reporting agency, credit counselor, financial advisor, or legal advisor.
  • Does not issue credit.
  • Does not make credit decisions.
  • Does not guarantee approval.
  • Does not charge users a fee or collect payment information.

All credit approvals and underwriting decisions are made solely by third-party lenders.

2. Eligibility

You must:

  • Be at least 18 years old;
  • Be a resident of the United States;
  • Have a valid U.S. Social Security Number if requesting credit-related services;
  • Provide truthful and complete information;
  • Use the Site solely for personal, non-commercial purposes.

3. Member Accounts

You may have the option to create a Member Account. If you do:
You certify that:

  • All information provided is accurate and current;
  • You are registering only for yourself;
  • You will not create multiple accounts;
  • You will not transfer, assign, or sell your account;
  • You will not use another person’s account;
  • You will not attempt to obtain consumer credit information under false pretenses or in violation of the Fair Credit Reporting Act.

You are responsible for maintaining confidentiality of your login credentials and for all activity occurring under your account.
If you believe your account has been compromised, you must notify us immediately.
We reserve the right to suspend, terminate, or restrict any account in our sole discretion.

4. Authorization to Obtain Credit Information

If you request personalized recommendations, you provide written instructions under the Fair Credit Reporting Act (FCRA) authorizing CreditSoup to obtain consumer report information for eligibility evaluation purposes.
You further authorize us to obtain updated credit report information from time to time in connection with refreshed eligibility evaluations and updated financial product recommendations, unless revoked.

This authorization:

  • Permits soft inquiries only;
  • Is not a credit application;
  • Does not impact your credit score.

You may revoke this authorization at any time through our privacy portal or by contacting us as described in our https://www.creditsoup.com/Privacy Policy.

5. Inquiry Process Disclaimer

Submitting information:

  • Is not a credit application;
  • Does not constitute pre-approval;
  • Does not guarantee credit;
  • Does not create a binding offer.

Conditional offers may be withdrawn or modified and may require a hard inquiry by the lender.

6. Electronic Communications (E-SIGN Consent)

By using the Site, you consent to receive communications electronically in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN).
To access communications, you must have:

  • Internet access;
  • A current web browser;
  • A valid email address;
  • PDF viewing capability.

You may withdraw consent by contacting us, though doing so may limit service availability.

7. SMS Communications

SMS communications are governed by our separate SMS Terms and Conditions.
We do not sell or share your phone number for third-party marketing.

8. Third-Party Offers and Content

When you select an offer, you are redirected to a third-party website.
We do not:

  • Control third-party websites;
  • Endorse third-party products;
  • Guarantee third-party terms;
  • Assume responsibility for third-party privacy or security practices.

Your interactions with third parties are solely between you and those parties.

9. Advertiser Disclosure

CreditSoup is an independent, advertising-supported comparison service. The offers that appear on this site are from companies from which CreditSoup receives compensation. This compensation may impact how and where products appear on this site (including, for example, the order in which they appear). CreditSoup does not include all companies or all offers available in the marketplace. CreditSoup may use other proprietary factors to impact offer listings on the website such as consumer selection or the likelihood of the applicant’s credit approval.

10. Prohibited Use

You agree not to:

  • Use bots, scrapers, spiders, crawlers, or automated tools;
  • Harvest data or contact information;
  • Reverse engineer, decompile, or attempt to access source code;
  • Circumvent security;
  • Upload malicious code;
  • Impersonate another individual;
  • Use false pretenses to obtain consumer report information;
  • Use the Site for unlawful purposes.

Unauthorized use may result in termination and legal action.

11. Intellectual Property

All content, design, layout, trade dress, graphics, software, algorithms, databases, and source code are owned or licensed by CreditSoup and protected by intellectual property laws.
No license is granted except the limited right to access the Site for personal use.

You may not:

  • Copy, reproduce, distribute, modify, republish, or create derivative works;
  • Use our trademarks without permission;
  • Extract or reuse substantial portions of the Site;
  • Reverse engineer proprietary matching methodologies.

All rights not expressly granted are reserved.

12. Feedback and Submissions

If you provide feedback, comments, suggestions, or testimonials (“Feedback”), you grant CreditSoup a non-exclusive, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use such Feedback for business, marketing, and product improvement purposes without compensation.
You represent that you have the rights necessary to grant this license.

13. Digital Millennium Copyright Act (DMCA)

If you believe content on the Site infringes your copyright, you may submit a written notice including:

  • Identification of the copyrighted work;
  • Identification of the allegedly infringing material;
  • Contact information;
  • A good faith statement;
  • A statement under penalty of perjury;
  • Your signature.

14. Disclaimer of Warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability

To the fullest extent permitted by law, CreditSoup and its affiliates, officers, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to:

  • Your use of or inability to use the Site;
  • Any credit report information obtained pursuant to your authorization;
  • Any inaccuracies in consumer reporting agency data;
  • Any credit decision made by a third-party lender;
  • Your interactions with third-party lenders or marketing partners;
  • Unauthorized access to or alteration of your information despite reasonable safeguards.

CreditSoup does not warrant the accuracy, completeness, or reliability of credit data obtained from third-party consumer reporting agencies.
Total liability shall not exceed $100.
If you are a California resident, you waive California Civil Code §1542.

16. Indemnification

You agree to indemnify and hold harmless CreditSoup from claims arising from:

  • Your use of the Site;
  • Your violation of these Terms;
  • Your misuse of consumer report information;
  • Your infringement of third-party rights.

17. Assignment

You may not assign these Terms.
We may assign these Terms in connection with a merger, acquisition, asset sale, or restructuring.

18. Arbitration Agreement and Class Action Waiver

This Arbitration Agreement is governed by the Federal Arbitration Act (FAA).
Any dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • Arbitration shall be individual only.
  • No class or representative actions.
  • Arbitration venue: South Dakota.
  • Remote proceedings permitted.
  • Small claims court actions permitted in your local jurisdiction.

30-Day Arbitration Opt-Out
You may opt out within 30 days by emailing us using our contact form found at https://www.creditsoup.com/contact-us.aspx and include “Subject: Arbitration Opt-Out” in the message.

19. Governing Law

Except as governed by the FAA, these Terms are governed by the laws of the State of South Dakota.

20. Entire Agreement; Conflict

These Terms, together with the Privacy Policy and SMS Terms, constitute the entire agreement.
If a conflict exists regarding personal data handling, the Privacy Policy controls.

21. Survival

The following provisions survive termination:

  • Arbitration
  • Limitation of Liability
  • Indemnification
  • Intellectual Property
  • Governing Law
  • Assignment

22. Modifications

We may update these Terms at any time. Continued use constitutes acceptance.

Card ratings may vary by category as the same card may receive a different rating based on that category.
